These rules apply to NASCAR® branded Debit Cards (‘Debit Card(s)’) offered through Bank of America.

Authorization to Share
You authorize Bank of America to provide your identification, transaction and experience information to the National Association for Stock Car Auto Racing, Inc. (“NASCAR” or “NASCAR, Inc.”), its agents and Augeo Affinity Marketing, Inc. ("Augeo") to the extent needed to (1) enroll you in NASCAR RacePoints® program; (2) to accrue and redeem NASCAR RacePoints rewards; and (3) reasonably assist Augeo with the administration of the NASCAR RacePoints program.

NASCAR® RacePoints® Program
The NASCAR RacePoints program is a rewards program offered by Augeo under license by NASCAR, Inc and is not a program of Bank of America, N.A. or FIA Card Services, N.A. The NASCAR RacePoints program has its own privacy policy and is not subject to the Bank of America privacy policy. Augeo is solely responsible for the terms and conditions of your participation and point accumulation in the NASCAR RacePoints program. Augeo may change the terms and conditions of the NASCAR RacePoints program at any time with or without prior notice. All NASCAR RacePoints terms and conditions apply to the NASCAR RacePoints rewards accumulated pursuant to these Rules.

Earning NASCAR RacePoints
While your NASCAR Checking Account is open, you will earn one NASCAR RacePoint for every four dollars of Net Debit Card Purchases. We calculate Net Debit Card Purchases as Point of Sale ("POS") purchases made with your NASCAR branded Debit Card in a calendar month minus any (a) credits related to POS purchases, (b) other adjustments to your deposit account related to POS purchases, (c) cash back from a POS transaction, (d) quasi-cash transactions, which are transactions convertible to cash and include the purchase of money orders, travelers checks, foreign currency, cashier's checks, gaming chips, and other similar instruments and things of value, (e) account funding transactions, including transfers to open or fund deposit, escrow, or brokerage accounts and purchases of stored-value cards.

If a Cardholder voluntarily closes the Card or we close the Card, all unused Points are immediately and irrevocably forfeited. We reserve the right to disqualify any Cardholder from participation in the Program, as a Cardholder, refuse to award Points for Card use, and close your Card if, in our sole judgment, you or any other person(s) using the Card, have violated any of these Rules or any of the Program Terms and Conditions, including but not limited to acts of fraud or other abuse.

We reserve the right to disqualify any Cardholder from earning Points from use of such Cardholder’s Card in the Program if, in our sole judgment, any Cardholder has violated applicable laws or regulations, fails to comply with these Rules or any of the Program Terms and Conditions, including any revisions or amendments hereof or thereof, or if his or her actions constitute fraud. Disqualification may result in termination of a Cardholder’s right to use the Card in the Program, termination of the participation of other persons with the same account, and/or loss of Points prior to their accrual in the participant’s RacePoints Account.

Joint Deposit Accounts
If your deposit account was opened in Arkansas, Arizona, California, Connecticut, Delaware, Washington D.C, Florida, Georgia, Illinois, Iowa, Kansas, Maine, Maryland, Massachusetts, Missouri, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas or Virginia and your deposit account is held by more than one individual, each individual may open the NASCAR® branded Debit Card associated with that deposit account type. Points will be credited to the NASCAR RacePoints account of the primary individual on the deposit account. Points will not be credited for use of any other Debit Card related to the same deposit account. If your deposit account was opened in Idaho or Washington and your deposit account is held by more than one individual and more than one depositor has or opens a NASCAR® branded Debit Card associated with that deposit account only one NASCAR RacePoints program will be credited for points pursuant to these Rules.
